Kathmandu. A California appeals court has upheld the conviction of Hollywood film producer Harvey Weinstein in the rape and sexual assault case and ordered him to be re-sentenced.

A three-judge panel of California’s Second District Court of Appeal delivered the unanimous ruling. While upholding the conviction, the court stated that the previously imposed sentence must be redetermined.

A spokesman for Weinstein expressed disappointment with the court’s decision, claiming he did not receive a fair hearing. However, he accepted the court’s decision to resentence him, concluding that the old sentence could not be upheld.

The decision comes a day after New York prosecutors decided not to proceed with a fourth trial in another rape case against Weinstein, after the complainant said she was unable to appear in court again to testify.

However, Weinstein is still serving a prison sentence in New York for another sex crime conviction, and in another rape case, a jury has twice failed to reach a unanimous verdict after an earlier verdict was overturned.

Weinstein, 74, was convicted in California in December 2022 of raping and sexually assaulting an Italian model and actress. He was sentenced to 16 years in prison at the time.
